NON-EXEMPT EMAIL POLICY

//NON-EXEMPT EMAIL POLICY

As we move towards the end of this year, a new policy will be added to BurgerBusters Inc. and Steaks of Virginia, L.L.C. Employee Policy Manual. The purpose of this policy is to instruct our non-exempt, hourly employees concerning the use of electronic communication on communication mediums such as cell-phones, text messaging devices, computers, laptops, and tablets about work related issues when not scheduled for work or when otherwise off work-duty.

All time spent by non-exempt employees using electronic communications for work purposes will be considered hours worked. To avoid incurring unnecessary expenses, electronic communication should not be used outside regularly sched-uled work hours unless required by or approved in advance by management. This includes all types of work-related com-munication.

Non-exempt, hourly employee should not check for, read, send, or respond to work related e-mails when off the clock un-less specifically authorized based on job duties or directed by management. All types of off-the-clock work is strictly pro-hibited.

Non-exempt hourly employees must accurately record all hours worked, including the use of electronic communications outside their normal work schedules or when off work-duty. Non-exempt hourly employees using electronic communica-tions for work-related correspondence during unauthorized times may be subject to discipline for violating this policy. Su-pervisors requiring non-exempt hourly employees to use electronic communications for work-related correspondence at unauthorized times (or requiring other off-the-clock work) are also subject to discipline up to and including termination. Once all employee policy manuals have been updated we will be holding retraining for all employees on the manual.
